Ask the court appointed attorney this question. All we know is what you have written. Getting the police report will not get him out any sooner. The court appointed attorney will be getting it, and then will know more about the case and what the state intends to use as evidence. You did not even tell us what the charges are. Pehaps, but the charge would probably be battery, not assault. These matters have very narrow defined meanings. An assualt is generally the threat to do physical harm, like raising a fist to someone. A battery is the actual touching.

Were you married to this woman, and then divorced? If so, is there a custody order in place, and from which state?

Assuming there is a custody order, you would need to file a motion to modify custody in the courts of the state where that order was granted. If not, you have six month to file in the state where the child was before the move; then the child\'s \"home state\" will change to Illinois. You would have to file there.
