Ask his criminal defense attorney about this after the attorney has learned all the facts and circumstances. Basically, there is not enough information here, and all we know is what you wrote. That is not enough, there are many more things that must be known to make a guess at what the prosecutor could go after.

You can file a motion to convert to a chapter 7. Whether your court requires that notice be provides to creditors or if the order converting the case without notice to creditors can be entered will depend upon the practice in your court. In our court and I believe in most, the judge will sign the order without requiring notice to creditors.
