What you ask is not just for basic legal advice. In order to fully answer you an attorney must know all of the facts, not just your version. There are at least two other versions which will be in the witness statement and the police report of this incident. Those thing must be known as well as the statute and case law on this specific topic.

When you violate probation, you basically subject yourself to facing the time that you were originally facing before being put on probation. You need to go see a local criminal defense attorney who knows what the judge does in similar circumstances.
Q: I am interested in purchasing a piece of property upon the owners death. Would a purchase option be the tool to use?

Yes, an option to purchase might be the way to go. I would check the title (have a title search done) in any case. This will tell you if they own the property as joint tenants with right of survivorship. If so, it is an open question whether your option would be enforceable following the death of one of the joint tenants. But if it\'s not a JTWROS, I suspect that your option would be good against any heirs. I suggest you ask an Oregon attorney about this.

You will need a court order appointing you as personal representative of your father's estate. Once you get that court order, the clerk will issue letters testamentary. That is a document signed by the court that states you are authorized to act on behalf of your father's estate.
Q: Do I have the legal right to take my 2 children (one not his biological and youngest is) and leave him to get a divorce?

You have the right to take both children and leave him to get a divorce. He also has the equal right to take his bio child and file for divorce. To obtain legal custody of his non bio child, he will have to overcome a presumption that you are acting in the child's best interests. That will be very hard for him to prove.
Q: What should I do?
Vincent J. Bernabei's answer
If you've made reasonable efforts to personally serve him to no avail, you may ask the court for an order authorizing service by publication. If he doesn't respond within 30 days, then you may obtain a default custody judgment. Once you have the custody judgment, you can obtain a writ of assistance directing local law enforcement to take the child and give the child to you. Once you have a custody judgment, law enforcement may be more willing to assist in locating him.
Q: At what point can a Judge review a filed Tort and deem it frivolous?

A judge will not deem a case to be "frivolous" unilaterally. The opposition should file a motion for summary judgment if the case has no merit whatsoever.

You can not obtain citizenship through this, however you can apply for a work authorization. The program is called DACA, which will allow you to work for 3 years in the United States. Contact an immigration attorney to help you with this process. All the best.

Get to the law library and do the research to find similar cases. This is much, much more than a basic legal question. Evidence of a crime that is in plain view while conducting a search, can potentially lead to other charges being brought.
