You need to consult a workers\' compensation attorney immediately. There are a number of rights that the insurance company may be violating. As for the value of the case, an attorney will need to send you to a doctor for another ime. THis should not be set up by the insurance company. The ime which is performed will determine the true value of the case. Also your wages, job status, and future treatment will all play a value of the case. We need to know what kind of visa you are on. EAD just means you have a work permit to work legally in the United States, it does not say anything about the type of visa you have. If you are on legal visa you will be able to bring the child here as a dependant and to guide you properly I need know the type of visa you and your husband are on. All I see in what you have written is conclusions, no facts which would cause me to believe that the conclusions are correct. When you believe that a crime has been committed, you should report it.

This certainly seems like an odd scenario and I would call your attorney immediately. It is very unusual for an IME doctor to perform any kind of medical treatment. ordinarily the IME report will take about a week or so. Sometimes the release of the IME is delayed, inadvertently or otherwise.
If you have not hired an attorney you should contact someone as soon as possible to discuss your situation and your rights. A workers' comp attorney is not paid unless they recover money for...

This person committed a crime. When that happens, the state prosecutes for the crime with a state or district attorney, a lawyer. That lawyer represents the citizens of the state. You are a victim of crime. See if there is a victim advocate at the local prosecutor's office.

The choice is yours, but basically in order to get the public defender appointed, you need to be indigent. The fact that you ask indicates to me that you are not indigent. At the very least you should go see a few private attorneys about the case, find out how much it might cost to hire them, and then choose one.
