Florida Questions & Answers
Q: heirship question in regards to Florida law
Answered on Mar 30, 2016

The mineral rights, as well as anything else in Peggy's estate, pass to her intestate heirs, who would be her children as well as Tom (or his estate).
Q: If I received noticed that the house is going foreclosure can i break the lease then

No, until and unless the foreclosure sale actually happens, you would be in breach of the lease were you to "break the lease" (do something in violation of the lease terms such as failing to make the lease payments when due). In fact, the landlord would have a strong case that, were you to stop making payments and the property were foreclosed as a result, you might be liable for the damages.
Q: If am in US since '02 & a political refugee from cuba & a felon here in the US. Can i visit Cuba or do i have to stay?

A lot of other important details are missing for us to give you an answer to this question. You need to talk to an immigration attorney in private to find out. Many immigration attorneys including me offer free consultations, make use of the consultations.
All the best.

Q: My son may have purchased a small amount of cocaine from a CI/Unvercover 3 months ago. Is he still at risk for arrest?
Q: My employer is forcing me to drive a semi without a commercial driver's license can I sue with video evidence

Not really sure what your damages would be, so hard to judge if it would be worth it. You could report them to the state for this illegal behavior. If they then fire you, you could sue them for retaliation which would be easier to win and clearer damages.
Q: LTD $ 2606 A MONTH, SS $1709 A MONTH DO I HAVE TO PAY BACK THE DIFFERENT TO LONG TERM DISABILITY

It depends what is in the LTD contract. You can contact us as we handle LTD and might be able to help you keep that money or at least a part thereof.
Q: My parental rights were terminated under the Step Parent Adoption in florida. How do I get child support to close case?

You may have to file with the court to get child support recovery moving in the right direction.
Q: Can someone give me an interpretation of Florida statute 61.10 and what someone has to do to attain this judgement?

First, if you want to look up a particular website, please see the following link: http://www.leg.state.fl.us/statutes/
Second, if you aren't able to see your kids and your wife is threatening a move, then you need to ask the court for an emergency hearing asap to resolve these issues. I would suggest you hire a private attorney so you don't waste valuable time and money.
Q: used to owe my ex on CS that wore late payments for total of $2,610.11 that was on 2014 it has already been catched up

Did you pay from 2009 to 2014 besides the arrears you speak of? If not, then you owe that additional amount before she finds you in contempt again. Just b/c you are paying on arrears doesn't mean that your existing obligation stops.
Q: I moved into my current apartment complex in August and have recently discovered mold. What can I do? Do I have a case?

You may have a claim that the place is uninhabitable, among other things, that warrant an early release of any lease.

Q: Why i loose the car i pay the bank every month even i owe the dealer $400

Because you owe the dealer. Why do you owe the dealer when you are paying the bank? Whatever arrangement you have made, you have obviously not abided by the agreement so the car has been repossessed or will be repossessed.
Q: The pasco county H2o has been banging on my door and even windows shouting, told 3 seperate neighbors im past due

Call the police and make a report for the harassment. Also call the Better Business Bureau. You can also contact the Federal Trade Commission and they have a great deal of material on what is and is not acceptable for payment collection.
Q: Can I get arrested in my new state with an out of state warrant, but my license has since changed to the new state?

Yes, you can be arrested and you will be taken back to the original place of the warrant and once that is resolved, then you will be transported back to FL to face whatever crime you committed here for which you were stopped and they found out you had a prior warrant. You can't run from these things and I promise you that it will happen at the most inconvenient moment such as on your way to work etc. As soon as you can deal with it, then deal with it. If you can afford a private atty. in FL,...
