Q: Can I sell property if I am administrator of an estate in Georgia without all heirs consent?

1 Answer | Asked in Other for Georgia on
Answered on Mar 30, 2016

You need to look into grave detail about what you are doing. This heir could make life very difficult and cost you money (I hope you have insurance to cover any mistakes the trust. You can always stop down a an heir and name someone from the bank and them then your brother is less likely to raise so much hell and you will be more a widget than the aggressor. Julie

Q: Is it illegal to call and ask about anothers banking account information

1 Answer | Asked in Other for Ohio on
Answered on Mar 30, 2016

A little more context is needed. It is foolish and you will just get rejected if you simply call up the bank and ask for someone else's information. If you use personal identifying information of another individual such as the last four digits of his or her social, name, and address, to attempt to obtain his or banking information, that would be illegal.

Q: how long does it takes before points come off your license, I have two two point tickets more than two yrs old

1 Answer | Asked in Other for Ohio on
Answered on Mar 30, 2016

You will get a twelve point suspension if you accumulate 12 points within a two year period. Note that the clock starts on the date of the first conviction within the two year period, not the date of the offense. So, for example, if you had this DUI situation in November, but were not convicted of it until March and got this latest ticket in February of this year, you would get a twelve point suspension letter. http://codes.ohio.gov/orc/4510.037

Q: I bought some property under the lake bed. Everyone on the lake property line stops short of the water.

1 Answer | Asked in Other for Georgia on
Answered on Mar 30, 2016

Was the property represented IN WRITING to be under the lake bed? What does the survey show? Did you have an inspection? The buyer is just as responsible for making sure that they get what they are buying as the seller is in what they are selling. See you documents, private or public, to see what it says. Without that information, nobody can tell you what your rights are.

Q: what kind of lawyer do I need to talk to about answering a judgement summons? It is a medical debt.

1 Answer | Asked in Other for Colorado on
Answered on Mar 29, 2016

I would recommend that you contact a general practice attorney. Any attorney can handle this type of work, but some specialists may not because they limit the scope of law they cover. Lastly, you can file a reply pro se (w/o a lawyer) and have an attorney appear after the filing (do not wait for too long to find an attorney though...).

Turning to the substance of your case. The doctor's office has simply filed a claim for repayment related to your outstanding medical bill. If you feel...

Q: I have been listed as the father of a child with no paternity test or acknowledged paternity paper.

1 Answer | Asked in Other for Virginia on
Answered on Mar 28, 2016

You'd have to file a petition to establish/disestablish paternity in the appropriate juvenile & domestic relations court. Then, if the mother denies that you are not the father, you would get the opportunity to take a DNA test. If it turns out that you are the father, you will have to cover the costs of the test. Consult with a local family law attorney to help guide you through the forms and process. Good luck.

Q: The case is still open but no court date has been set. How long can a case like this be open?

1 Answer | Asked in Other for Georgia on
Answered on Mar 27, 2016

It depends on the docket of that particular court. Plus, the discovery of 6 months must pass unless the parties agree otherwise. If you would like to know for sure, then contact the clerk of court or the Judge's clerk and ask when your case is coming up for trial.

Q: my son was kept past his release date due to some mistake what can we do

1 Answer | Asked in Other for Georgia on
Answered on Mar 26, 2016

How long was he kept past his release date? If it was several days, then you can bring it to the DA's attention to see if they can provide any recourse (such as provide for lost wages if a job was interrupted, etc.). If was just a couple of hours, then you have to do a cost/benefit analysis and determine if it is worth pursuing. Your son has to have suffered some sort of damage from the error beyond just hurt feelings or pain and suffering so if he didn't lose anything from a late release,...

Q: My boss clearly favors young people. HR claims that he cannot discriminate because he is 74 himself. Is this true?

1 Answer | Asked in Other, Employment Discrimination and Employment Law for Texas on
Answered on Mar 25, 2016

Laws prohibiting workplace discrimination do not provide an immunity to a person who discriminates against a class to which the person belongs. Under Federal laws, typically only the employer can be sued for illegal discrimination, not individuals acting on the employer's behalf. Many state laws, however, allow for the individuals (such as supervisors) to be sued for violating the State's anti-discrimination laws. Those individuals are not off the hook for illegal discrimination just because...

Q: Can I leave the US while my i-485/i-130 is pending if I have a current and valid E3 visa?

1 Answer | Asked in Other for Colorado on
Answered on Mar 25, 2016

As a general rule, the only thing that matters to USCIS is whether you have changed your residence outside of the US. A honeymoon/travel is not normally classified as a change of residence or intent to leave the US permanently. I recommend that you schedule an appointment with the USCIS is Denver; they will advise you on any necessary steps (it can be hard to get in but just keep trying daily - trust me, something will open up). In the alternative you can meet with an immigration attorney to...
