Yes you may be able to transfer the H1B, if company B agrees to file your H1B as well. Although it might be a bit too early to file it because you would not have three or more payslips to attach. And yes you can work on OPT for company B if company A does not work out. All the best.

If the state or city has given you a criminal citation then you have to go through the court process. If you don't show up to court they will issue a warrant. It is good to get an attorney on board as theft can affect your immigration status, your employment, your housing and your credibility if you ever testify. I would sit down and talk to an attorney and go over your case. You can also possibly get everything figured out in court with the person affected.

They can have enough evidence to charge you with possession if you are in the vicinity. If they have enough evidence to convict someone of that crime is another question. It would be good to sit down with an attorney and go over your story to figure out your culpability as well as how the officers stopped and obtained the evidenced.

Retail theft is a theft charge that is specific to a theft of retail. If they charged someone with two different theft charges with the same incident you will probably want to contact an attorney as there may be a double jeopardy issue. It's also good to contact an attorney for theft charges because it is a crime of dishonesty which can affect employment, housing, immigration and your credibility when that person gives a testimony.

You can't get a public defender on a traffic violation. If you are worried about your record it might be good to get a lawyer. If you pay the fine or take a plea in abeyance it will be counted as an automatic guilty that can affect your insurance.

What is your immigration status? If you are US citizen you can file a fiance petition for your fiance to come here and get married. That is the legal way to get married. If you are not an US citizen he needs to get some other non-immigrant visa to come here to get married, but it is complicated procedure. I suggest you talk to an immigration attorney to help you with this process. Many immigration attorneys including me offer free consultations. All the best.

1. There is no way to speed up the process.

2. Without knowing which country you are from, it is not possible to say how long it will take. (I suggest checking the visa bulletin)

3. You can get a work permit on a student visa but having an approved I-130 petition does not make you eligible for a work permit.
