Q: if youve been arrested for distribution of child pornography and have been on supervised release for 9 months

1 Answer | Asked in Criminal Law for Ohio on
Answered on Mar 30, 2016

You really need to get a lawyer. This is a very serious situation. It is likely you waived your speedy trial rights at some point in there, and you may now want to revoke that waiver, but you need to discuss the facts privately with an attorney first.

Q: Can we be forced to move when the lease is up?

1 Answer | Asked in Landlord - Tenant for Ohio on
Answered on Mar 30, 2016

Provided he has given proper notice as defined in the lease, and not less than 30 days, if rent is monthly, the landlord is within his rights to terminate your lease at the agreed upon time. It sounds like you gave notice as required in the lease as well, which means you've likely terminated it. Your options are a grand total of two: (1) negotiate something with the landlord; (2) become a holdover tenant and face eviction proceedings.

The judge will have that power, and that this is a second infraction makes it more likely. However, it sounds like you have one of the few remaining reasonable judges, if you get the same one. Many are suspending kids on their first ticket.

Q: Is it illegal to call and ask about anothers banking account information

1 Answer | Asked in Other for Ohio on
Answered on Mar 30, 2016

A little more context is needed. It is foolish and you will just get rejected if you simply call up the bank and ask for someone else's information. If you use personal identifying information of another individual such as the last four digits of his or her social, name, and address, to attempt to obtain his or banking information, that would be illegal.

The fine is a virtual certainty. The license suspension is a possibility. Ohio's juvenile courts have become sort of suspension happy when it comes to juvenile traffic offenses.

Q: how long does it takes before points come off your license, I have two two point tickets more than two yrs old

1 Answer | Asked in Other for Ohio on
Answered on Mar 30, 2016

You will get a twelve point suspension if you accumulate 12 points within a two year period. Note that the clock starts on the date of the first conviction within the two year period, not the date of the offense. So, for example, if you had this DUI situation in November, but were not convicted of it until March and got this latest ticket in February of this year, you would get a twelve point suspension letter. http://codes.ohio.gov/orc/4510.037

1 Answer | Asked in Other for Ohio on
Answered on Mar 22, 2016

There is no way to predict what a judge will do at sentencing with any accuracy without a lot more information. It's possible such a deal has been worked out, but it's also possible the judge will give him considerable time. Upon conviction the pre-trial protection order will terminate, but judges can and often do put another order in place during the probationary period.
