You need an attorney to help you navigate this as this is very serious. No, you do not have to face him in court if you file for a protective order as you can do that without him, but you may have to face him at hearing later (see the family violence division in your county). Yes, he could be in contempt of court and he should go to jail for this. It doesn't matter whether he wants to "sign the papers" if you want a divorce, then file for one and state that the reason is domestic violence....

Take it up with DFACs. Something must have gone wrong for the grandparents to have guardianship so you need to go to DFACs and follow a safety plan, drug testing, and anything else they require before you have a chance at getting your child back.
