You do not need a lawyer for most anything, but whether or not it is wise to have one is another matter. If both of you understand exactly what is going on and the risks involved, you can file one yourself.

Q: As the father how do I get full custody if the mother has signed a consent of guardianship to child's grandmother?

1 Answer | Asked in Family Law for Oregon on
Answered on Apr 5, 2016

If there is already a court order for custody, then you should file a motion to modify custody. If there is no court order for custody, then you should file a new action to obtain custody of your child. You should also object to the guardianship proceeding. You don't automatically get full custody after mother signed away her custodial rights, but there is a presumption that your rights to custody are superior to grandmother's rights.

I do not do public education law by any means, but you have a situation where they possibly could rightful ban him from the school due to the threats he made. People can be trespassed from public places, TriMet does it all the time.

Q: We just purchased a home 6 months ago, and just found out that the seller lied about the siding being replaced.

1 Answer | Asked in Real Estate Law for Oregon on
Answered on Mar 31, 2016

Breach of contract has a six year statute of limitations, which can be tolled in some instances. Potentially here it could be based on the discovery rule, so you may be able to sue the original owner (though you might have to sue those you bought it from with them bringing in the original owner).

The big question is will it be worth it? How does the siding not being replaced affect the value of the house (as in do you now need to speed $10k to replace it). If it is just an annoyance, it...

Q: My ex is willfully defying a court order for me to take custody of our daughter. Can I have her arrested for that?

1 Answer | Asked in Family Law for Oregon on

Police tend to not want to get involved in disputes such as this, unless there is a court order. I would suggest talking with your divorce attorney or the one handling your custody case.

1 Answer | Asked in Criminal Law and Traffic Tickets for Oregon on
Answered on Mar 25, 2016

Doesn't matter if the ticket was for speeding or anything else, you were not supposed to be driving. If you did not go to court, they will likely issue a bench warrant, and it will not look good to your PO.

Q: Took FMLA, now they want me to return to a non-equivalent job in Oregon

1 Answer | Asked in Employment Law for Oregon on
Answered on Mar 21, 2016

Generally speaking, they do not have to hold open your job, just provide you with an equivalent position. That gets fact intensive and there are no real black and white answers, as that basically gets into opinions. You might sit down with a local employment law attorney, best if they do FMLA, and go over all of the facts to get their opinion on the situation.

Q: what is a Oregon Statue

1 Answer | Asked in Other for Oregon on
Answered on Mar 16, 2016

An Oregon statue is a three-dimensional work of art located in the state of Oregon. An Oregon Statute is a law passed by the legislature, abbreviated ORS. As to your other question, sort of. You could sell it, but it would have no real legal affect and leave you open to a variety of issues. Plus, unless you are selling to a moron, they will go through escrow and find out you are not on the deed (I make an exception as to if you are not on the deed but still an owner versus you are not on the...
