It's possible. Employees have a duty of loyalty during the course of their employment. You don't necessarily need a non-compete to be subjected to a lawsuit for soliciting clients whether or not they sign up with your employer.

It is not likely a police officer will call you. They usually just show up to find you if you have been charged with a crime and there's a warrant for your arrest. Consult local defense counsel.

Since your boyfriend was the one charged, he should consult with a criminal defense attorney. Depending on what happened at his arraignment or preliminary hearing, he may be able to request a modification. But there's not much that you yourself can do.

You do not need to respond to a private person requesting an interview. But you could potentially still be charged with theft and prosecuted. If the police are calling you or if the police show up you have a right against self-incrimination. In fact, talking with a store employee - you could incriminate yourself as well. You should consult with a local criminal defense attorney regarding your options.
