A wise man's country is the world. --Aristippus (435-360 BC), as quoted by Diogenes Laertius, Lives of Eminent Philosphers "There is hope. I see traces of men." Aristippus was shipwrecked on the island of Rhodes in the Aegean Sea. He and his fellow survivors did not know where they were or if the island was inhabited. But he sees geometric figures drawn on the sand. [read post]

DUDE, ALL IT TAKES IS A TAX ON REMITTANCES: Vicente Fox to Trump: When will you understand that I’m not paying for that f***ing wall? And you think there’s a political downside to taxing money sent from the U.S. to Mexico? Of course, if you’re really mean you could require anyone transferring funds abroad to prove they’re in the United States legally. And I’m pretty sure that could be done by executive order under existing presidential powers. [read post]

Seyfarth Synopsis: In the high-profile EEOC race discrimination litigation against Bass Pro, the Court denied the EEOC’s motion for a ruling that would have allowed it to include in its § 706 claims those individuals who had not yet applied to work for Bass Pro when the mandatory Title VII conciliation process took place. *** The latest chapter of the EEOC’s race discrimination case against Bass Pro (which we blogged about here and here) involves yet another attempt by the government to cast a broad net and increase the number of claimants in its lawsuit. … [read post]

The logo of Japan’s Toyota Motor Corp. is seen in a showroom in Tokyo on January 6, 2017. (Photo credit: KAZUHIRO NOGI/AFP/Getty Images) It’s Fix The Tax Code Friday! On Thursday, President-elect Trump issued a warning to Toyota via Twitter that the company must “Build plant in U.S. or pay big border tax.” (For the sake of clarification, according to the New York Times, some of the details in the tweet were not “entirely accurate.” Specifically, Toyota is not planning to build a new Corolla factory in Baja, Mexico, where it already has a… [read post]

Thank you to Dan, Karen and the LHB team for this kind invitation. I am a late adopter of social media (just went on FB in November!) but I have reliably checked LHB since I began thinking of myself as a legal historian. I have greatly enjoyed reading about the processes of writing monographs that bloggers described with such aplomb. I still remember Sophia Lee’s post about the ground-staking chapters of her book, Karen Tani’s description of working on her cover design, Ajay Mehotra’s meditations on intellectual history and the fiscal state, Mitra Sharafi’s… [read post]

The very beginningAs the novitiate Maria wisely counseled the von Trapp children, the beginning is a very good place to start. So let me start with writing the introduction.Unlike many monograph writers, I did not have a dissertation to “turn into a book.” (I do remember a conversation with Barbara Welke who fumed at the seamlessness that this phrase implied…). As a pre-tenure professor, I dutifully attended many faculty development workshops devoted to this process of dissertation into book. Not once did anyone offer a workshop on the inverse: how to turn articles… [read post]

THE LAMENTATION OF THEIR WOMEN: Lindy West: I’ve left Twitter. It is unusable for anyone but trolls, robots and dictators. Actually, I share most of her criticisms of Twitter, except for her laughable claim that the “hate mobbing” all comes from the right. [read post]

At the top of the GOP agenda is repealing the Affordable Care Act (ACA). We do not yet know what, if anything, would replace it. Several proposals have been put forward, the most detailed one from U.S. Rep. (and Trump's pick for HHS Secretary) Tom Price, the Empowering  Patients First Act, which would provide tax credits to be used to purchase health insurance on the private market. Many [read post]

The very first proposal of the new Congress was to shut down the only independent ethics body -- that idea was stopped for now because of public outrage. There's an even worse idea building up steam, one that should be killed dead forever; that idea is that we should neuter the Consumer Financial Protection Bureau (CFPB) so that big banks and businesses don't have to worry about any consequences for mistreating Americans in the marketplace . . . you know, the way it was in the runup to the big crash that launched the Great Recession, when America realized that toxic financial products… [read post]

People from all over the world flock to Florida for family vacations throughout the year. Many of these family vacations are centered on our state’s amusement and theme parks. Unfortunately, as experienced injury attorneys many people suffer from the onset of sudden illness, receive injuries, and some die riding the theme parks’ attractions. Our personal injury attorneys report that despite the theme parks and attractions bringing significant revenue to Florida each year, the state do not regulate the safety of its theme parks. Furthermore, a federal agency, and not a… [read post]

JOHN HINDERAKER: Today’s Intelligence Report Proves Nothing. The report constitutes, allegedly, the long-awaited proof that Russia (specifically, Vladimir Putin) meddled in the 2016 presidential election by, most notably, hacking into email accounts of the Democratic National Committee and Hillary Clinton campaign manager John Podesta and distributing emails from those accounts to Wikileaks and others. Does the report prove that claim? No, it merely states it. There is zero evidence in the report tying the Russian government (or anyone else) to the crude spearfishing effort or… [read post]

While there is some freedom in estate planning, certain choices actually may be harmful. You want to protect the assets you have acquired in life through hard work and thrift, yes? You also want to provide for your loved ones, yes? But you do not know where to start. You are thinking about using an online will generator. A will is a will, right? Wrong. Do you really want to gamble when it comes to planning to protect everyone you love and everything you have? According to an article in Modern Medicine titled “Estate planning: Don’t make these mistakes”, there are… [read post]

Recently I’ve been receiving more and more spam phone calls. With iOS 10 Apple allowed developers to create extensions that would interface with the Phone.app and allow incoming calls to be checked against a database of suspected spammers. Out of desperation, I’ve tried a few of these Apps claiming to screen or block suspected spam callers as they’ve popped up in the App store. Thus far the only one I’ve found that has worked somewhat reliably is Hiya. (Glenn Fleishman writing for Macworld has a more extensive review) Read more… [read post]
