Q: I purchased a car last Tuesday, if the seller knowingly sold it to me with a big problem (transmission) what can I do?

1 Answer | Asked in Lemon Law for Colorado on
Answered on Apr 12, 2016

You can void the sale and/or seek a reduction in price. Try talking to the seller. If the seller will not negotiate, you will need to file a small claims case. For small claims, you can file pro se (w/o an attorney) or with an attorney. Your local courthouse will have self-help resources also try the CO courts webpage (link: http://www.intotolegal.com/upcoming%20Events/Forms.html ).

Q: Mechanic has had car for three years and still isn't fixed. Plus he keeps giving us the run around. What should I do?

1 Answer | Asked in Lemon Law for Georgia on
Answered on Mar 8, 2016

Get the car from the mechanic and take the car to a different mechanic. You have a duty to mitigate your damages so a court is not going to be very sympathetic to you for not taking matters into your own hands a long time ago so the longer you delay the worse your situation gets for you and the less any court is going to give you any recourse.

Q: Can I put Car Rental Fees on my Small Claims as part of Demand$?

1 Answer | Asked in Lemon Law and Products Liability for New Jersey on
Answered on Dec 23, 2015

You can certainly add any legitimate claim to a lawsuit. However, even in Small Claims Court, you will find that Ford or the dealership will be represented by an attorney. You, therefore will be at a disadvantage. You MAY be able to find an attorney to represent you on a Flat fee basis, but not necessarily. Consider your options carefully. Good luck.

Q: is there anything i can do legally in missouri about buying a car as is, and it breaking down 35 miles later?

1 Answer | Asked in Lemon Law for Missouri on
Answered on Oct 8, 2015

The issue with "as is" vehicles is that they are not covered under Missouri's lemon law. The lemon law only applies to new vehicles, not used vehicles. You may have an action for a breech of warranty, depending on what the dealer represented to you in the buying process.

Many attorneys offer free consultations, so feel free to call around and ask for legal advice.

Q: Hello, I recently left my job due to sexual harassment and belittlement at the work place. What lawyer would I go to??

1 Answer | Asked in Employment Law and Lemon Law for California on
Answered on Sep 15, 2015

When choosing an attorney for this legal issue consider: specialization, experience, results, character, compatibility. You want an attorney with a verdict or two in a sexual harassment case because the defense counsel will do a background check and even make calls to other defense attorneys who may have done business with your attorney. You also want to choose someone you can work with. You will be a partner with your attorney, and so think of it like picking a friend. You want both...

Q: Does the car dealership have to give me a refund?

1 Answer | Asked in Lemon Law for New Jersey on
Answered on Aug 15, 2015

You need to retain counsel and have the attorney send the dealer a letter. The contract you signed will need to be reviewed by a retainer, but it is unlikely that a waiver of the Lemon law will be upheld by a Court. Good luck.

Q: Less than to month I pay a mechanic shop to replace my car engine with use engine now that use engine is broken

1 Answer | Asked in Lemon Law for Florida on
Answered on Jul 25, 2015

Did you mean two months, not to months? Have you spoken with the mechanic shop about this? Was there a contract that you signed and have you read the contract? It seems to me based upon the very limited facts that you provided, that you might have a suit against them for breach of an implied warranty for fitness of use. But hiring an attorney to sue would probably cost more than it would cost to get another engine or get the used one fixed. Negotiate with the mechanic shop about this.
