Q: Is it required to go to a doctor? Also would it be worth my time to create a lawsuit?

1 Answer | Asked in Personal Injury for Washington on
Answered on Apr 11, 2016

I recommend treatment if injuries resulted form an incident with OR without the possibility of pursuing a claim or lawsuit. If there is a legal remedy or cause of action for negligence, there may be a case or claim to pursue. You should find out your rights through a consultation with a local personal injury attorney. Good luck.

Q: My car was damaged in the lot of a bar by drunk patrons fighting. There was security, they did nothing. Is owner liable?

1 Answer | Asked in Personal Injury for Washington on
Answered on Apr 6, 2016

There may be a case or claim to pursue if you can prove that the bar was negligent and the damage to your vehicle was foreseeable and preventable. You may also check to see if there is any criminal case pending for the fight. You may be able to recover your damage through restitution on the criminal case. Good luck.

Q: If someone breaks into my home, and my dog attacks them, can they sue?

1 Answer | Asked in Personal Injury for Washington on
Answered on Mar 9, 2016

People can always sue, but here the likelihood of them winning is low. Your question is listed as Washington, but you are posting from California. If it was in California, despite strict liability for dog bites, the person cannot be trespassing, so they would loose. In any case, if you are sued, turn it into your homeowner's insurance or renter's insurance which should then defend you.

1 Answer | Asked in Criminal Law for Washington on
Answered on Mar 8, 2016

If you have the sex, and then change your mind about buying the clothing, could you walk away without paying? Having never paid someone for sex, I don't know the answer, but I'm under the impression that there would be repercussions for failing to pay.

Q: r can I use tort liability against police officer accusing me in traffic ticket as a violation to to pay instead report

1 Answer | Asked in Personal Injury for Washington on
Answered on Feb 24, 2016

This is really hard to read, but FYI you have no right to a jury trial for infractions, and you would have hard time proving liability on a police officer.

Q: In sophomore year of highschool I had a teacher who labeled a spray bottle of water with the words "Mormon repellent",

1 Answer | Asked in Personal Injury for Washington on
Answered on Feb 24, 2016

This would likely turn on how long ago this was. Assuming you were a minor, that would toll the statute of limitations, but only while you remained a minor. A tort claim notice also would be needed.

Q: I would like to know if I can have the evidence suppressed or if officers were in violation of 4th amendment.

1 Answer | Asked in Criminal Law for Washington on
Answered on Feb 12, 2016

It is an interesting question. But it appears that the officer had a valid arrest warrant. If that is the case, officers have the right to a limited intrusion into the residence to arrest the suspect. And upon a valid arrest, if they find a weapon on the suspect, that would not be a violation of his rights. There would need to be more information regarding who answered the door, if there was any conversation as to consent to enter or not. The person having standing to challenge the entry...

Q: If an individual is charged and is awaiting trial, doesn't he/ she have the right to police reports to the case?

1 Answer | Asked in Criminal Law for Washington on
Answered on Feb 12, 2016

The short answer is yes. If the individual has a lawyer (and they should if they are charged with a crime - it is just good sense), then their lawyer will get the police reports and the client can meet with the attorney and go over the reports together. If the individual is representing themselves (never a good idea), then they can "demand discovery" from the prosecution as a lawyer would. But the individual has to basically go in front of the judge and ask to proceed pro se (represent...

If someone enters lawfully, but then remains unlawfully (exceeds the scope of the original invitation or permission) with the intent to commit a crime, they can be guilty of a burglary.

You can do as many jobs as you want when you are on OPT, but you will have to report all those jobs and they pay taxes properly. If you get an H1 you can not work for anyone else except the employer who sponsored your H1 visa. All the best.

Q: Can a child in Mexico get permission to enter USA with family members with visas.

1 Answer | Asked in Immigration Law for Washington on
Answered on Jan 29, 2016

Okay in this situation she might have a problem coming in. She will most likely be denied entry since her father is illegal. You asked the same question before but forgot to mention the fact that her father was staying here without legal papers. I suggest you contact an attorney immediately as there are immigration raids going on all over the country and this wouldn't be a good time to bring his daughter in. Many immigration attorneys including me offer free consultations, make use of the...
