How do you know they called in a hit and run? If you reported it to your insurance company, and the other party has your vehicle information they will likely eventually report it to your insurer, at which point your insurer will already have notice of the claim because you've set it up. You should contact the person at the insurance company who sent you the Title Form. You should not sign and return the form before speaking with someone. They should be paying you for the value of your vehicle, and you can also discuss reimbursement for rental expenses. However, if the vehicle is totaled, they do not have to cover your rental expenses.

I understand that the State of Texas may require that the dog owner knew or should have known about the dangerous propensities of the dog. If your dog never bit a person or attacked a person in the past, you may have a defense to this action. The internet reviews will get you no where. If they did bad work, that is mostly on you as the person who hired them. That said, I would counterclaim as to breach of contract in that the work performed was not of the quality contracted for, in that he breached implied warranties. I would also look to see if the person is licensed as a contractor, as irrigation is often an area that requires a licensed contractor. If he is not licensed, then any contract may be void.
