Q: Renter left without paying last month's rent. Can I use her security deposit to cover her missed rent during Covid?
Gregory L Abbott
Gregory L Abbott answered on May 5, 2020

Certainly - the moratorium is on forcibly evicting a tenant for failing to pay rent during the pandemic; to date there has been no forgiveness of rent. It is, after all, one of the main purposes of having a security deposit. Just be sure to provide a written accounting for how much you are... Read more »

Q: Is the legal effect of old criminal expungement law still valid from 2007, although it was completely replaced in 2014?

I have a class D felony expunged in Arkansas. The conviction is from 1996 and the order to seal was issued in 2007. At that time in 2007 all civil rights including the right to possess firearms, were part of the expungement effect. However as of 2014 the law was repealed and under the new law,... Read more »

The new law won't impact your old expungement. You should check with ACIC (Arkansas Criminal Information Center) to see if you have your firearm rights.

What you have to do is the "right thing." You do not get to keep the item if you did not pay for the item. Either pay the shipper for it or work out a way to return it, that is the right thing to do.

Q: I moved out of my apartment of 3 years and was charged for touch up paint and blind cleaning. Can landlord do that?

Can the landlord use my security deposit for normal wear and tear? There was no damage to the walls or blinds.

Gregory L Abbott
Gregory L Abbott answered on May 5, 2020

Cleaning and painting - touch up or otherwise - are not considered normal wear and tear and yes, a landlord can charge you for them and withhold payment from a security deposit refund so long as the charges are reasonable for the work done.

A Washington attorney could advise best, but you await an answer for two weeks. In terms of the eviction-related elements of your matter, a landlord-tenant attorney would need to advise on that. In terms of the tort-based elements involving bed bugs, they are tough cases and many attorneys are... Read more »
