Unless that will is found and it says something different your dad’s children should have inherited half of his estate. Hire a probate attorney right away. The longer you wait the harder it is going to get to straighten this out.

You should setup an LLC in the state where you operate. Then determine if an S-election is appropriate for your LLC.

If you establish in WY you'll have to file a foreign registration in CA.

Hire a professional.

For tax there is no difference. For state business compliance issues a Corporation has slightly more things that have to be done to maintain the corporate veil. Sure, you can sue him for "fraud." However, it is unlikely you will prevail because you already have a judgment against him for the unpaid room rent.
