Q: Hello, I have been paying my daughter's quinceanera for a year and it was supposed to be in May 29, 2020. They won't

refund my money plus they say I have to continue to make payments or I will be in breach of contract and lose my $$$. They said I can pospone to next month but, a bunch of my family have already canceled. what can I do??

Take a look at the contract with them to see if there there is any termination/cancellation provision that speaks to this first. For example, they may take a small cancellation fee instead of the whole amount since you are giving them more than 30 days' notice.

If you are in GA, you need to talk to a GA attorney about current case law. Most info you find online is out of date and not current case law.

It sounds like you should carefully review the terms of the LTA or the RFP; it could be intended for bidders that are not already engaged in providing services to the organization. Sales agreement said bldg does not convey and would be removed. Gave owner 30 day extension in agreement.

The North Carolina General Statutes contain the information that needs to be on your lien form. Its set out almost in a form in the statute. See 44A-12. However, I would recommend an attorney as the lien process can be complicated.

Multiple issues control this. First, is the case over yet. If so, then yes.

In still pending, on misdemeanor cases, after 12 months, you can ask the court to release you as surety.

I doubt that you have to move out or that the management company can force you. Also, in any event the Tennessee Supreme Court has extended an order restricting evictions for a period of time in light of the covid 19 issue.

BUT, right now, IF you get this all in writing, you drove the car for FREE for two months AND you can get a

Q: Can I bring criminal charges against a company for theft for not returning my deposit?

The company is located in Florida; I am located in Texas. I sent in a deposit and 2 days later, I called to cancel. The company confirmed they would return my money but to date, I haven't seen a penny after 30 business days. Can criminal charges be brought on the individual/owner for theft.

This sounds like a civil matter, and unless an unreasonable amount of time passes, with no reply, you could consider filing a police report. However, you should exhaust your civil remedies first.

Probably a bad idea as you are not a car dealer. But if you do: execute a security agreement; execute a promissory note with interest and collection costs included; and put yourself as the Lienholder on the Title. Be prepared to not get paid.

The "one week to respond" is baloney---but hard to tell if they are saying you have one week to do something you are obligated to do under the contract....different.

You raise a valid point, but the office could argue they incur packaging, handling, and other costs as a result of the measures. Whoever told you that partners can "avoid contractual liability" merely by creating an LLC--composed of the same partners who signed the contract--was wrong. Your new LLC cannot protect you or your partner.
