Many years ago, I had a criminal charge that was handled on a Deferred Prosecution. I was fully complient with all terms and the charge was dismissed one year later. I thought it was to be expunged.
I'm wondering why this charge showed up and what I can do to get it expunged. Thanks in... Read more »

Unfortunately, when cases are dismissed after a deferred period, it is still considered to be a "conviction" because there was a finding of guilt. Although the case has been dismissed it may still show up on background checks as a dismissed charge. How your case would be handled is... Read more »
Husband and I are filing chapter 7 to discharge a civil judgment. However our son is also on the judgment, will they come after him after we file?

In a Ch. 7, the automatic stay, and the permanent injunction included in the final Discharge, only protects the debtors who file the bankruptcy case. Assuming that the civil judgment is not for a non-dischargeable kind of debt (e.g., fraud, willful destruction, and specified kinds of personal... Read more »
All my cases have been closed dispite not giving DNA, ive called the local bails bonds and they said that all my cases show that they are closed and that there wasnt any court dates or warrant issuance.

Absolutely. The normal process is to set a court date first, then issue a warrant at that hearing. But if providing a DNA sample was a court requirement, and it wasn't done, then the court can definitely issue a warrant.
The responsible driver ran him over and hit multiple cars. We are not sure what types of compensation he is eligible for, and we do not know if a DUI test was performed on the responsible driver. The responsible driver only has liability insurance. What type of lawyer should he get?

He should talk to a personal injury firm, but ideally one that also does some criminal / DUI work.
They will be able to pursue maximum compensation for him, and also guide him through the criminal process and obtain information for him so he understands how the case is being handled on the... Read more »
Even if he didnt press charges or participate in the municipal case against defendant/girlfriend? Ok he got a summons to appear at my MTR hearing to testify for the state. If you are asking if a DA can subpoena an alleged victim or witness to testify in a case than YES the DA can do this. There are different ways or methods of getting a subpoena to a person so if the person that is being asked to testify has questions about their rights that person should consult... Read more »
i was hospitalized for ten days with a breathing problem in my lungs this was over 10 yrs ago which has been a problem for me

It sounds like you may have an occupational disease. Unless some 3rd party (read: not your employer) was responsible for your condition, you are likely limited to a workers' compensation claim. You don't state whether you still work there or not. The deadline for occupational diseases is... Read more »
I recently got a ticket for going "too fast for road conditions" and sliding over an embankment. The rental company's insurance got billed instead of my own, so I'm not sure if it would even affect my insurance rates, and that's the only reason I would consider hiring one... Read more »

That depends. That the rental car company insurance will pay for the damage is not the point. You received the ticket because of your driving and the vehicle damage issue is not relevant. If you decide to defend the ticket yourself and you lose because the court rules against you, it will go on... Read more »
I have my green card residency for more than 20 years and I want to apply for my citizenship but I don't know if I can because I have a DUI on my background. What can I do and what is the process like?

It seems unlikely that a single DUI would negatively impact your application for citizenship. Applicants for citizenship must show 5 years of good moral character, so if the DUI was in the last five years you might want to wait until more than five years have passed. You will also want to make sure... Read more »

Short answer yes, it happens all the time.
Most often from traffic cameras, but that is not the only source.
The fact that the ticket can be issued that way doesn't mean that these tickets can't be beaten though. A ticket that was issued by mail almost always has... Read more »
I was assaulted and the police came to the scene and made a report. I told them I wanted to file. But the Cop just gave me his card with a incident # on it. I've called but can't seem to get a return call.

I would keep calling the officer, he is the one who can tell you the status of the investigation.
I would also call the prosecutor's office that the report is to be sent to. They can tell you if their office has received the report yet, and if they have made a decision about whether... Read more »

We live in Washington state. I am receiving support from the non custodial parent until he graduates high school per the support agreement.

An 18 year old is considered an adult and is no longer subject to a court order for parenting time.

Can I hire a lawyer and fire the public defender ?

Yes you can withdraw a plea of guilty to a case before sentencing but it is VERY VERY HARD to do.
Typically it isn't allowed by the Judge because when you entered your plea of guilty the Judge asked you a bunch of questions about your decision to enter the plea of guilty and whether... Read more »

I'm sorry that happened to you. The process here will be dictated by the contract with the rental car company. Assuming you have insurance, the worst case scenario is you've got to pay the deductible for your own insurance company.
