Not all my other brothers and sisters have given him their part of the house.

You may want to consult with an attorney who can help you with the proper course of action. A DNA test will show who the biological father is so that this can be corrected.

No. Incarcerated individuals retain legal title and ownership over assets acquired before their sentence.

Time to review everything with a local landlord-tenant attorney. Depending upon the exact details, you likely will need to file a lawsuit to eject them (as opposed to evicting them).
