Q: Hello, I have a question regarding a purchase contract for a residential property

is a contract dead after the expiration date if the buyer backs out at last minute and neither party evoked time of essence. This contract is in NYS. There were no contingencies on the contract that were not met by either party.

Q: My long term girlfriend recently passed without a will.

We were living in a home titled in her sole name with no mortgage. The only living heirs are her siblings and they have agreed to assign all rights in the estate to me. What is the process to do this? What are the potential tax implications?

You are not an heir at law, so the siblings cannot simply disclaim their interests because disclaimers are treated as if they had predeceased your girlfriend, and that would not result in the estate assets going to you. Q: My last question really wasn't answered. Is it standard to have a parenting plan cover 6 mo in advance or a year?

Trying to figure out how long a parenting plan is usually scheduled for. A year, 6 months or maybe even less?

I like to do a parenting plan that covers timesharing until the child is 18 years old.

Q: How far in advance can you set a parenting plan? What is typical? I would not mind doing the whole year but ex doesnt

My ex's job has her traveling quire a bit and she constantly wants to change our week to week schedule. She would like to do a parenting plan only a month or two in advance however I would be fine with a year, excluding summers. It is a constant source of conflict.

Typically a parenting plan is done based on the current best interests of the child. With that said it’s better to have a frank discussion with your attorney and tell them your expectations and if they can’t meet those you should hire someone that can.
