Q: How does one file a notice of appeal judgment
Katie Marie Charleston
Katie Marie Charleston answered on Aug 11, 2021

This will depend on whether your case is a state or federal case. I am licensed in the 10th Circuit Court of Appeals (federal), but not the state of Colorado. Either way there are time and procedural requirements to file your appeal. You should consult an attorney to guide you through the process.

The dog will be treated exactly as all your other property and I would make sure your final orders specifically state who gets the dog; shared custody cannot be ordered because it’s a dog not a child.

If you bought the dog during the marriage and it was not a replacement dog for one you...

See if HSPPR is still allowing at home stray holds. If yes, contact them stating you found this dog wandering multiple times and you’re afraid it will get hurt if allowed to roam but you’d rather have the dog do the required stray hold at your home instead of their shelter. State you want to... Read more »

Q: I have a pending I-751, filed the N-400 and are scheduled for an interview, will they automatically adjudicate both?

I didn’t not include a letter when I filed the N-400 asking them to adjudicate together the two, but I did provide the I-751 Receipt notice that contained the 18 month extension on my conditional residence. Is there something I should do for them to adjudicate both?

In domestic relations court, child support can only go back to the date of filing. You can file for support and a determination of paternity now. If the children were born during a marriage between you and the mother and/or if your name is on the birth certificates, then you are the presumed father.

Q: Help me understand what unless the parties agree otherwise means

What does it mean when the courts say that ? The other parent she’ll have supervised parenting time every weekend for 4 hours. Unless the parties agree otherwise?

John Hyland Barrett III
John Hyland Barrett III answered on Jul 30, 2021

This language means that the parties can come to their own agreement. If they do not agree, then the court order must be followed. So, in this case, there is supervised visitation for 4 hours every weekend, but the parties may agree to some other schedule.

Most parents alternate the tax benefits. You can see if the other parent will agree. You can always ask for a modification, however you would have to justify why it would be in the best interests of the child for you to take the tax benefit each year.
