Q: I need to know if I can sue my father for money he owed in a divorce with my mother.

My parents divorced in 2016, my father owes us half of the property value but he has never paid any of it. If you were guardian of your mother you could pursue her action on her behalf. Also a Durable Power of Attorney drafted correctly would allow you to proceed on her behalf. You can't "take it into your own hands" as the cause of action belongs to your Mother. Good Luck!

Q: I was divorced in 2011 and at that time I decided to have my maiden name restored.

On the first page of The Final Judgement on line #7 it says "The wife's former name of () is restored".

Spousal support/alimony is statutory and limited by length of marriage and time cohabiting prior to same as well as income differential based on your facts as you have presented it does not look like a viable claim. What is important is how and when the assets were paid for. If they were accrued and paid during the marriage then they are marital assets regardless of title. Yes, as a spouse , she acquired rights in the home and any other real estate and property that you own. If you sell the home, she would have to agree to sign the transfer deed. Contact your county's legal aid office. Your chances of finding an attorney outside of legal aid to take on a divorce case pro bono is slim to none.
