Q: Can a 13 year old and a 17 year old date if there only 3 years and 11 months apart in age?

Robert Jason De Groot's answer
Date? What do you mean exactly by that. Some say it includes sex, others say it does not. A child under 15 cannot consent to sex in FL, and the 17 year old can be charged with a very serious crime if sex occurs between them.

Not just no, but hell no. A 12 year old has no business being with a 17 or 18 year old. Plus he can be charged with Aggravated Sexual Assault of a Child. He could get life in prison for this offense. On the brighter side he was probably end up being someone's girlfriend in prison.

Q: can a 19 year old have sexual intercourse with a 16 year old in texas
Brian John Willett's answer
It depends. If the 19 year old is less than 3 years older than the 16 year old it is an affirmative defense to the criminal charge. Once the 16 year old turns 17 everything is legal. Just wait until 16 year old turns 17.

Q: What's the worse that can be done to a 16-year-old who has a felony against him if there is little evidence against him?
Brian John Willett's answer
Well obviously if he is on probation it has already been decided that he committed the offense. As far as what they can do it depends on how her was charged if he was charged with an indeterminate sentence he could go to TJJD (juvenile prison) until he is 19. If he was sentenced under a determinate sentence it would depend on the level of offense. It could be anywhere from 10 to 40 years in TJJD with a possible transfer to the adult prison system.

Q: I'm 15 and my girlfriend is 17. Is it illegal if we have consensual sex?
Matthew Williams' answer
As long as you are both juveniles (under 18) it is technically legal. The law doesn't punish silly teenage curiosity. It becomes more of a problem once one of you turns 18. It is, however, a bad idea generally.
Q: How could a 16yr old legally get married to a 19yrold in ohio and be imancipated
Matthew Williams' answer
A 16 year old who marries a 19 year old, with parental permission, and who either has completed high school or holds a full time job could be considered emancipated by a court. Ohio has no legal process for becoming emancipated, but a court may find that a child is emancipated, if he or she is self sufficient. The obvious problem there is that you must be in court already, over one thing or another, for that to happen.
Q: The legal age of consent in Ohio is 16, is there any strings attached?
Matthew Williams' answer
Potentially yes. The legal age of consent is 16. A private, sexual relationship between a minor and adult is thus technically legal. HOWEVER, there are lots of other ways for the adult to get in real trouble here. First, child pornography is serious business. Any images or videos of a person under 18, which are sexually explicit in nature, are child pornography. Second, some states have different rules. A romantic getaway can turn into criminal charges. Third, parents. Until you are 18, you...
Q: can a 13 year old date/have "conceptual" sex with a 15 year old
1 Answer | Asked in Juvenile Law for Florida on Mar 30, 2015
Answered on Apr 1, 2015
Robert Jason De Groot's answer
Neither of them has the ability to consent to sex. It is not legal. But what you can and should do depends upon the actual facts. You should at least inform them that they can each be charged with a very serious sex offense, a 2nd degree felony called sexual battery in FL, which carries a maximum punishment of 15 year in prison. Each could potentially be housed in a juvenile detention facility until age 19.

That would depend upon whether your parents consent to your moving out.
Q: im a 16yo and my boyfriend is 19 can he get introuble by the law in ohio if my parents don't allow it? in Ohio
Matthew Williams' answer
If your parents were to get really upset and you were routinely disobeying them to be with this person, you could be adjudicated delinquent or unruly and he could be charged with contributing to the delinquency of a minor. While you are a juvenile, you are required to obey your parents within reason. Prison is not a likely outcome, but he could get in legal trouble.
Q: I'm 23 years of age is it illegal for me to date a 17 year old that will be 18 in less then 2 months
Matthew Williams' answer
Dating is never illegal. The age of consent for sexual activity in Ohio is 16. However, there are numerous ways an adult engaged in a sexual relationship with a child can get in legal trouble. I suggest you wait a few months before engaging in any sexual activity.
