Q: Minor got compensation for injuries during an accident, a trust account, he is 18 now, can he manage his account now?
1 Answer | Asked in Juvenile Law for California on Sep 2, 2015
Answered on Sep 3, 2015
Andy Chen's answer
It depends on what the court\'s order establishing the trust said. If the order said the trust continues until the kid turns 18 and he is 18 now, then the trust should end and the kid get whatever is in the trust. 18 is the typical age for termination of a trust, but depending on the situation, it could be older (e.g. 21, 25, etc) as well.

Q: Can a 16 year old get emancipated in California without parent permission by judge decision.
1 Answer | Asked in Juvenile Law for California on Aug 29, 2015
Answered on Sep 1, 2015
Andy Chen's answer
The answer to your question is yes, but the process is fairly difficult. At a minimum, the judge has to be convinced that your parents don\'t mind if you are emancipated, you have a way of supporting yourself once you become emancipated, you can manage your own money if emancipated, and that emancipation is good for you in the long run.
The neglect and depression you mention would have to be expounded upon, I think.

Q: my godson has been unruly and has had the cops called on him multiple times
Matthew Williams' answer
Get your godson the help he needs from a psychiatrist. Don\'t try to force him into the juvenile system. First, you really can\'t do anything but report his misbehavior and see whether the police decide to do anything about it. Second, once he is in the system things are likely to get worse not better.

You have to file an action terminating her parent's parental rights and asking the court to allow you to adopt. To terminate their rights, you have to show they are unfit parents and are not likely to get help to become fit parents. You will need to hire a lawyer to do this, these are not easy cases, and even if you succeed in getting their rights terminated, you want to make sure the adoption is done correctly. And if there is a custody order in another state, jurisdiction may be a complicated...
Q: Can a 7 year old boy get in trouble for hitting a 4 year old girl in the state of texas
Terrence H Thorgaard's answer
If you are asking about a criminal (or juvenile delinquency prosecution, it is unlikely. A seven year old child isn't normally prosecuted for mere hitting. Was the girl injured?
Or, if you are asking about civil liability, it would depend (among other things), on the extent of the damages and what assets he may have. There may also be statutes imposing civil liability upon parents for the torts committed by their children. Thus his parents could (possibly) "get in trouble".

One would think that it should decrease every time one of the children reaches the age of majority, right? But possibly not; it depends upon the terms of the custody order and the specific law in Missouri.
