Q: Can someone demand their $ back from a sale of a horse 7 months later?

1 Answer | Asked in Animal / Dog Law for Colorado on
Answered on Apr 15, 2016

Review your purchase agreement to see who carries the risk of loss for the horse. The buyer can bring suit in small claims if they can prove that you knowingly withheld information (low heel can be a sign of ringbone). If the buyer cannot prove knowingly withholding on the part of the seller, the case moves into a grey area that is wholly driven by the fact and circumstances of your case.

There is no direct legal action that you can pursue to prevent a child from leaving your home (in fact, you will violate the law if you prevent him from leaving for an unreasonable period of time). You may want to consider modifying your custody agreement - your local courthouse will have self-help resources.

You may want to contact a lawyer, but you can file/defend pro se (w/o an attorney) -- pro se is common for...

Q: My Dad worked for the railroad and now has lung cancer. He worked around diesel exhaust. Can he sue the railroad?

1 Answer | Asked in Other for Illinois on
Answered on Apr 15, 2016

Yes - if he was exposed to diesel exhaust at work he may very well have a case. Diesel Exhaust is now considered a carcinogen by the World Health Organization. He would need to bring his action under the Federal Employers Liability Act. If he rode on locomotives, the Locomotive Inspection Act and Code of Federal Regulations will come into play as well. These are complicated toxic tort claims however, so make sure that you retain counsel who is very familiar with both FELA law and toxic tort...

Q: Went 2 court for 1st time & judge gave me 60 days to get lawyer. Because of bail I can't afford one yet. What will happen

1 Answer | Asked in Criminal Law for Tennessee on

If you could afford to bail yourself out but not hire a lawyer, it sounds like you should have stayed in jail in order to get a public defender. The judge will probably not ask to you to plead until you have retained an attorney or decided to represent yourself (which I do not recommend).
