There was no will. Veterans Administration sent a check to last known address made payable to the estate. Bank would not cash. VA wants proof that wife is the sole heir before they will reissue check. How does she prove she is the sole heir?

Hire a competent attorney to draft and execute an Affidavit of Heirship. It should also state who the sole Next-Of -Kin is (the same person as the heir). If it is a substantial sum, record it first, then send it to the VA with a letter requesting the check be reissued in the name of the sole... Read more »
If the management company represents a community association and one of the owner did not pay their monthly due on time and you’re only sending an automated reminder electronic notice, do you need a collection agency license in order to send that reminder notice?

HOAs, condo associations, and their property or association management companies, are all excluded from the definition of a debt collector under the Federal Fair Debt Collection Practices Act. The association itself is excluded because it originated the debt obligation, and the management company... Read more »

An estate needs to be opened, in the county (or City of Baltimore) where your father resided at the time of his death. Either your father had a will that named someone to act as Personal Representative or executor, or in the absence of a will or the person named not being willing or able to act,... Read more »

There really isn't such a category like that here. But there's a category of Health Care Law. That might be the closest thing. Good luck

You cannot do anything unless you are the Personal Representative of your brother's estate. You become that by petitioning to open an estate for your brother in the jurisdiction where he resided at the time of his death. In Maryland, that would be a county (or City of Baltimore) Register of... Read more »

I'm sorry to hear that something like this happened to someone who brings comfort and support to a community. It is legal, unless it could be proven otherwise, which could be difficult. Hopefully, it was not an act of cruelty, but instead, maybe part of the cautionary measures people are taking in... Read more »

Anyone can file a complaint. Whether or not it is something the police would do anything about is another thing. Keep a copy of her postings (hard copy), showing time and date; likewise any instagram or other transmission. Keep your response to a simple "I disagree." and say no more. Ideally, just... Currently I'm a law student and I would love to be a great lawyer or even a judge one day. But the thing is I would also love to make video's (Tiktok, Youtube). My question is whether it's possible to combine the two. I want to be taken seriously as a lawyer (or judge) but I also would love to make... Read more »

You could combine your interests, but it will require more research on your part than can be covered in a brief post here. If you go online, you'll see people who are active attorneys deliver lectures about law for the public's education or for continuing education purposes for other attorneys. In... Read more »
So my mother and I own a house together. I am on the deed of the house. She is trying to evict my boyfriend and father of my child out of the house we all live in. He pays one bill that is in her name. Can I fight her on trying to evict him? Can she even legally evict him if hes paying her... Read more »

If your mother owns the home, then she can evict your boyfriend. Simple as that. Since he has lived there 2+ years, she will have to go through the formal eviction process as he has clearly established residency there. It does not matter at all that he has been helping to pay bills.

I choose a career in law because I was not cut out to be a doctor. It is also the most appropriate profession for me as a person.

I'm sorry for your ordeal. If this is a medical facility, try to get in touch with the administrative staff or social workers. It could be difficult to get through due to many facilities operating short-handed, and medical professionals being in acute short supply. If her commitment is related to... Read more »

If the actual title was signed, then I don't believe it matters legally whether the owner subsequently passed away. Obviously, it needs to be processed by the Secretary of State for issuance of a new title.

That sounds like something that would generally be up to individual employers in their policies for travel expense reimbursement more so than something addressed by state law. Your post remains open for five weeks - for the most meaningful input, you could check with a Virginia employment attorney.... Read more »
