Companies are allowed to charge non refundable deposits if they give you clear and unequivocal notice. Sometimes these notices have to be posted at the cash registers. Read your contract.

We live in California now but this property is in the state of New Mexico

Might I suggest that you repost this for New Mexico under "probate" and "estate planning" so you get a response from some attorneys there. It must be done under New Mexico law since there is no will to probate here.
