Q: Can you invest in stocks while collecting workers compensation and SSDI? I know they send a 1099 at the end of the year.

Does this count towards substantial gainful employment? I want to invest my money but I don't want it to be counted against me. I am also collecting SSDI and I don't want to lose my benefits.

No. Investment income is "unearned income" and there is no limit on the amount of unearned income you can generate for yourself. SSDI and workers' compensation benefits are only affected by actual employment/work income. Self-trading your own investments is not considered employment.

Q: If father and son have never met and father lives out of state will they force me to send them to him?

Father lives in Florida son in Michigan. Child is seven years old has never had any contact with his father. Father has lost custody of two children in the past. One is in foster care. Highly unlikely. If anything, a period of time for your son to get to know this man may take place. That could be in the form of video conferencing. Then, depending on how that goes, the father may be afforded some parenting time to take place here in Michigan.

Q: In a Federal Case out of NJ as the prevailing party who gets the legal fees that are awarded?

If a client was charged 225hr by the attorney but the attorney files for legal fees at 500Hr as the prevailing party how is the 300 dollars addtional over the 225hr charged to the client awarded? Does all of the addtional 300 dollars awarded go the client or does a portion go the the attorney?

I have never heard of a Federal case involving family law, nor have I heard of any attorney charging only $225 an hour for a Federal case and certainly not in New Jersey.
