Q: A mechanic messed up my brakes while "inspecting them" and I nearly got in a wreck. Can I press criminal charges?

brakes were functional before service. The mechanic told me explicitly I did not need brake work. The brakes failed, I noticed a brake fluid leak, second party mechanic confirmed and documented that the brakes had been reassembled incorrectly causing the leak.

This sounds more like a civil case where you could file an action against the mechanic, his garage or their insurance company if you can prove it was his fault. I don’t think there would be criminal charges unless you can prove this person directly tried to hurt you rather than just doing bad... Read more »

I can answer your problem with an experience of my own. A Case Manager refused to promptly supply a replacement Arbitrator. He simply became unavailable. Two weeks passed without any responses to my demand that he supply three new names for the parties.

Q: Is it proper for prosecutor to enter NG plea when not in open court and where all talks were off the record?

Petty traffic case. Remote hearing (arraignment) takes place. Pros offers a plea and I decline. Pros then instructs clerk to schedule for trial. I never said that I would plead NG, nor did I refuse to enter a plea. I presumed I would have a hearing before a judge to do this, but it has been entered... Read more »

Nothing here was improper. It would be typical, particularly in a petty misdemeanor, that you wouldn’t necessarily enter a not guilty plea in front of a judge. It is a procedural step and the failure to do so isn’t a significant error.

Yes, if the police have a search warrant they can search the home whether or not you are there.
