Q: I got my green card through my mom who got her citizenship this year. I have already spent 4 years in the USA.

I arrived in the USA in June 2018. I applied for my green card in September 2020. Until now I did not receive my green card. Since I already spent 4 Years in Usa and my mom is a US citizen, do you think that I'm eligible to fill out a citizenship application?

There is not information to know whether you derived U.S. citizenship through your mother when she naturalized, as this depends on a number of factors. Q: how to deposit a cashiers check when the payee is deceased

The cashier check is made out to the deceased and drawn on the deceased bank account. The deceased bank account is frozen.

You will need to make a claim in the deceased's probate estate, assuming there is an estate. If the account has a beneficiary and there is no estate, you may be out of luck. Consult legal counsel if the check is big enough to be worthwhile.

You can do a letter or a lawsuit. You know your former business partner better than an attorney, so if you think the partner would be motivated o resolve if sent a letter then that's the way to go. Q: My son received a speeding ticket yesterday. He was doing 59 in a 45. The officer put on the ticket that he was 15 to 19

Over on the ticket. He was also in a work truck and he put down a personal vehicle

Q: Can the other women sue for $10k she gave my husband during their affair?

No written exchanges about the money. When he broke it off he asked her about it and she replied “I don’t give a f***” now after some stalking on her part she filed a warrant in debt for it. Does she have a case ?

It really depends on what was the basis of giving the $10,000 or the agreement (even if verbal) around the money. Q: 8 years ago, released from Tennessee without home plan or transfer of custody. Has been non-extraditable. Arrested now

Was in an atv accident with my daughter and a virginia state police charged me with reckless endangerment of a minor (no) and persuaded tennessee to extradite. I have not had my court date for the infraction to plead not guilty to this charge.

It appears that Tennessee issued a warrant of extradition for a misdemeanor which is usually non-etraditable and the VA State police were simply following up that. Q: A company is refusing to pay me over $9000 that I earned as an independent contractor. What are my options?

Yes, you have a few options: 1) send them a demand letter threatening a lawsuit if they don't pay you; or 2) pass on the letter and simply fie a lawsuit. Q: how relevant is an assault (in 1995) on your record if you are immigrating to the US from Canada?

Q: Should a Canadian citizen have a criminal record (Assault 266 CC) removed if applying for US permanent resident status?

Should the record be pardoned? Should we just leave it as it and apply. The situation was a one off situation and corrective measures were taken and there have been no other situations that have come after.

Q: What happens when a life insurance policy says to the estatee? Does it spilt between all children

My mother died and had three life insurance policy’s. I was the sole beneficiary for all but one. The last one states it goes to the estatee, nobody was named. Who will that policy go to? Will it split between all children or will we have to go to court for one person to get it?

A principal must have the capacity to contract to give a power to an attorney-in-fact. That generally requires understand the nature and consequences of the legal act. Q: Do I need to give notice to a person staying in my property in the state of Virginia? More details below.

Does not pay rent and is not in a lease agreement. Property damage has occurred by this person. If a notice needs to be given how long? Also do I need to go through the court system as in an eviction?

If you're going to evict based on non-payment or property damage, then you do need to give notice and evict through the court process. If you're evicting based on a person who has no tenancy rights then arguably no notice is required, but even then, the safest thing to do is give notice.... Read more »

Q: Rental property in Virginia that needs to be fixed but renter is not ready to pay.

Hi i have a rental property in Virginia. The tenant has moved out after the lease completed. They did not do a wakthru. There is mold and appliances have been abused. the repairs are more than the deposit amount. they are refusing to pay. what are my options.

You can go to court and plead not guilty but I don't know any judge that would accept that mistake as a legal defense if the identifying information on the ticket is otherwise correct. Q: What fines are most likely associated with non-compliance with notice requirements per statute in final divorce decree?

Ex-spouse received fraudulent spousal support payments for two years. The ex-spouse also did not notify the other party of the new location as stated in the court order. The divorce decree was entered by the Norfolk Circuit Court in the state of Virginia.
