Q: Can you be served notice of hearing for restraining order from a different state via text message or email?

My husband served me with divorce papers last Monday. He lives in Washington State and i have moved here in Florida a week and a half ago. I just received a text message informing me that a restraining order will be heard against me via Zoom tomorrow.

You would have to look at the rules from the other state. In Florida, personal service is required, meaning a person hands you the papers. You may want to consult with a Washington attorney about this issue.

Q: My child is now 31 years old. can I sue his father for arrearages that were owed in a child support case from 2006?

In 2006 they closed my child support case because both parents moved out of the state of Oregon even though my son was not of age. Colorado which is where I live now refuse to open a new case. If he owes arrears then you can collect it.

Q: I'm on felony divers. 2 for 2 probation, failed drug test, sent to resid. treatment, left for funeral came back drugs

were found in my belongings, which I openly admitted to the possibility of, they kicked me out, now I'm supposed to report to my probation officer, what is going to happen?

Any number of thing. You could be removed and probated. You could be removed, sentenced and sentenced to the penitentiary. You could be sent to an IOP facility. You could be sent to an in patient facility. Best advice is to hire the best criminal defense attorney and get them started on it.

Q: Can i sue the humane society if the dog i rescued bit my face?

The answer is it depends. In some cases, a shelter may have knowingly played down a dog’s aggressive tendencies or even failed to mention it to a family considering adopting the dog. In a case like that, there may be grounds for legal action against the organization that adopted the dog out.

Q: Can a school take your phone, and search it without asking. Nor having a warrant.

Asking for a friend, their phone was taken and searched to remove a video containing a school fight that was happening. They first took their phone and then my friend grabbed their phone back and started arguing with the Assistant Principle. Was this justified or should there be farther actions... Read more »

The 4th amendment has nothing to do with this since it wasn't law enforcement who took the phone. When you are a student in a school - even a public school - you do not have the same constitutional protections you otherwise would have outside of school. Schools can set policies and confiscate...
